Terms of Service

Spot A Pup ("we," "us," or "our") is operated by SPOT A PUP LLC. These Terms govern use of spotapup.com and related services. By using the platform, you agree to these Terms and acknowledge our Privacy Policy. You must be at least 18 to register, list puppies, or transact with other users.

Spot A Pup connects prospective puppy buyers with independent breeders. We do not breed, own, house, inspect, transport, or sell puppies. Breeders and buyers independently determine their agreements and are responsible for their own conduct and compliance with law.

Provide accurate account details, protect your credentials, and promptly report suspected unauthorized access. We may restrict or terminate accounts for fraud, violations of these Terms, or security concerns, subject to applicable law.

Breeders must have legal authority to advertise animals; accurately describe breed, age, health, pedigree, registration, availability, and price; comply with animal welfare and applicable licensing and sale laws; and provide truthful information to buyers. Breeders are solely responsible for veterinary records, contracts, representations, warranties, and animal care.

Buyers should independently research breeders, verify animal and health information, review purchase agreements, and exercise caution when sending funds. Spot A Pup does not guarantee a puppy’s health, temperament, pedigree, availability, or suitability.

The current platform does not provide integrated identity verification. We may add third-party verification in the future. If introduced, a verification badge will reflect only the checks completed, not an endorsement, guarantee of animal welfare, or assurance against fraud.

You retain ownership of content you upload and grant Spot A Pup a nonexclusive, worldwide, royalty-free license to host, display, reproduce, and adapt it as reasonably needed to operate and promote the platform. You warrant you have rights to upload it. We may remove misleading, infringing, unlawful, or abusive content.

AI-assisted search and breed recommendations may be incomplete or inaccurate. Verify material facts independently. AI output is informational and is not veterinary, legal, or other professional advice. Do not submit sensitive personal data in general search prompts.

The platform currently charges no platform fees and does not process puppy purchases. We may later offer subscriptions, promotions, or integrated payments, with separate pricing, billing, cancellation, refund, and transaction terms presented before any charge. We will not initiate recurring charges without authorization.

Do not post fraudulent listings, misrepresent identity, violate animal welfare laws, harass users, infringe rights, scrape data without permission, interfere with security, distribute malware, or facilitate unlawful transactions.

We may use third-party hosting, analytics, AI, identity, and payment providers. Their independent services may have separate terms and privacy notices.

We may change, suspend, or discontinue features for maintenance, security, or business reasons. We will provide notice and seek consent for material changes where required by law.

To the maximum extent allowed by law, the platform is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. Nonwaivable consumer rights remain unaffected.

To the extent permitted by law, Spot A Pup and its personnel are not liable for indirect, incidental, special, consequential, or punitive damages from use of the platform, including disputes or failed transactions between users. Nothing excludes liability that cannot lawfully be excluded.

To the extent permitted by law, you agree to indemnify Spot A Pup against third-party claims arising from your unlawful conduct, material misrepresentations, infringement, or violations of these Terms, excluding claims attributable to our own conduct where law prohibits shifting liability.

You may request account closure at hello@spotapup.com. We may retain information where needed for legal obligations, fraud prevention, security, or disputes, as explained in our Privacy Policy.

Wisconsin law governs these Terms, except where mandatory consumer protection rules require otherwise. Contact hello@spotapup.com to attempt informal resolution. These Terms do not waive nonwaivable consumer rights.

If a provision is unenforceable, the remainder stays in effect to the extent allowed by law.
